Claims, Guarantees, and Professional Liability Insurance

While we cannot guarantee that no claims will be awarded in the future, we believe the responsible course of action is to carry Professional Liability Insurance. To minimize the possibility of a claim, we have implemented the following procedures:

• We will diligently strive to avoid any such claims by continuing to utilize our “Seven-Step Quality Assurance Program.”
• We will continue to submit full documentation for the Owner/Client’s review to minimize any potential claims.
• Addenda will be issued for any errors and/or omissions discovered prior to the awarding of any construction contract.
• During any phase of the construction project, we will immediately report any unsafe conditions to our Professional Liability Insurance carrier and our client that might give rise to a claim.
• Should a claim be presented, a timely fact-finding conference will be held with all concerned parties to determine and address all relevant issues.
• Subject to the approval of our insurance carrier, we would have no objection to including an arbitration provision in our contract to resolve any such claims.
• We will request the participation of our insurance carrier to arrive at a fair and equitable resolution.

FF&A’s Past Experience and Success: Most of the commissions we receive are not for new construction. These projects are the result of changes in site conditions, changes in the mission of the site, changes in applicable codes, etc. We usually serve as consultants to the prime professional on these projects. This means that the MPE (Mechanical, Plumbing, and Electrical) disciplines must be designed in a fraction of the total design time, coordinated, and completed to align with the other documents. The unique concept of construction management practiced in West Texas requires firm bids from MPE subcontractors before the construction manager commits to a final price.
